This Privacy Policy applies to the collection, storage, use and disclosure of personal information by Barlow Property Holdings Pty Ltd t/a Mick Barlow Property (ABN: 12 666 830 306) (‘we’, ‘us’, ‘Mick Barlow Property’). Mick Barlow Property is committed to protecting your privacy and has adopted a set of principles in this Privacy Policy which is consistent with the Privacy Act 1988 (Cth) (the Act) and the Australian Privacy Principles (APPs).

You acknowledge that by giving us your personal information, doing business with us, making enquiries with us, or visiting our website you agree that your personal information will be dealt with as set out in this Privacy Policy.

We reserve the right to revise this Privacy Policy or any part of it at our discretion and without notice. Alternatively, you may contact our Privacy Officer using the contact information at the end of this Policy for more information or an updated copy of this Policy. By engaging in any of the activities listed in paragraph 2.1 (below) after we have revised our Privacy Policy, including by visiting our website or doing business with us, you consent to any revisions we may have made.

 

1. PERSONAL INFORMATION WE COLLECT

1.1 The personal information we collect and hold includes:

(a) names, addresses and contact information (including, but not limited to, telephone numbers, social media identifiers and email addresses);

(b) photo identification and any information contained in that identification (including, but not limited to, your driver’s license or passport);

(c) any information connected to your online account where you use an online platform (such as a property listing website or social media) to contact us;

(d) data collected by website traffic monitors such as Google Analytics (including demographics, browsing behaviour, session statistics and user identification) in relation to our website;

(e) occupation details, employer details and contact information, employment references and history, rental references and history, rental referee contact information;

(f) information relevant to a person’s education, including student status, institution and faculty details;

(g) information disclosed by personal referrers you have nominated;

(h) relationship status;

(i) bank statements, account details, and any information relating to remuneration or currency of employment such as contracts, payslips and letters of reference;

(j) financial information, including bank account details, type and amount of credit, identification information, default information, insolvency information, information relating to court proceedings and credit infringements, and other personal information about credit worthiness such as credit ratings;

(k) insurance information, including insurer contact details, policy numbers and holder information, certificates of currency and copies of insurance policies where applicable;

(l) information about staff, directors and employees including information as required in the normal course of human resource management and the operation of a business defined in the Act as “employee records”;

(m) information about current and previous clients, suppliers or contractors with whom Mick Barlow Property has dealings;

(n) title documents held in respect of real property, including title searches, lease conveyancing enquiries and any information which may be reasonably expected to appear in a contract for the sale of real property;

(o) any information contained in strata or owners corporation documents, including certificates issued under s 119 of the Unit Titles (Management) Act;

(p) information incidental to our management of a property, including (but not limited to) personal information contained in photographs, notations, inspection reports, maintenance reports.

1.2 To the extent that we do collect and hold sensitive information, we will only use it for the purpose for which it was collected or a related purpose in accordance with the Act, or otherwise where you give your consent to the use or disclosure for another purpose. Sensitive information is defined in the Act as information included (but not limited to) information about racial or ethnic origin; political opinions; membership of a political association; religious beliefs or affiliations; philosophical beliefs; membership of a professional or trade association; membership of a trade union; sexual preferences or practices; or criminal record.

1.3 If you are a tenant, you consent to the collection of any sensitive information we may collect as part of an inspection of a property, specifically where we take photographs of a property for the purpose of making an inventory and condition report. Mick Barlow Property will not use photographs containing sensitive information for any purpose other than:

(a) reporting the state of the property to the lessor;

(b) ensuring that any maintenance and rectification works can be carried out; and

(c) making applications to the ACT Civil and Administrative Tribunal, or another relevant dispute resolution authority.

 

2. HOW WE COLLECT AND HOLD PERSONAL INFORMATION

2.1 We collect your personal information directly from you in the course of our relationship with you. Information about you must only be collected by lawful, reasonable and fair means and will only be used for the purposes listed in paragraphs 3 and 4 below. We generally collect personal information when you:

(a) are an owner who engages to sell, buy or otherwise provide services in respect of a property;

(b) apply for a tenancy in a property or units plan that we are engaged to manage;

(c) are a tenant in a property or units plan that we are engaged to manage;

(d) apply for employment with us (including obtaining information from your references, recruiter, previous employers and any other background checks we deem appropriate);

(e) are an employee with us;

(f) provide a service to Mick Barlow Property (for example, where you are contracted to do work on behalf of an owner or are engaged to provide a quote) or receive a service from Mick Barlow Property (including attending an exhibition, meeting, interview or telephone call);

(g) contact us or engage with us through our website, our social media, or property listing platforms; or

(h) view our website or take specific actions on our website, noting that we use Google Analytics software to track website traffic and user engagement.

We may also collect information about you from third parties at our discretion where we deem it appropriate in order to provide part or all of our services, review an application or otherwise in the ordinary course of business.

If you provide information about a third party, you agree that you have that person’s consent to provide that information for the purpose for which you provide it to Mick Barlow Property. You agree that you have either provided that third party with a copy of this Policy or have advised them of where it may be found.

2.2 Where we received unsolicited personal information about you that:

(a) we have not requested; and

(b) we could not have lawfully obtained if we had requested it;

then we will destroy or de-identify that information.

 

3. WHY WE COLLECT PERSONAL INFORMATION

3.1 Mick Barlow Property collects your personal information to:

(a) provide and administer our products and services, including market properties for vendors and landlords, facilitate transactions for sales and leasing, assess and originate your application for finance or mortgage insurance and manage that finance, property concierge services, verify your identity and for security purposes, conduct credit checks and process payments (if applicable);

(b) respond to your submissions and enquiries about our products and services and property listings;

(c) provide customer support, including conducting, investigating and responding to enquiries, surveys, feedback, comments and complaints;

(d) distribute our newsletters and other communications either alone or with the assistance of third-party service providers on information about us, our conferences, training and events, our property listings and our related products and services;

(e) plan, market, host and facilitate our conferences, training sessions and events;

(f) inform and conduct marketing activities including the continued promotion of our products and services; and

(g) maintain records and comply with our legal obligations.

 

4. DISCLOSURE OF PERSONAL INFORMATION

4.1 We only disclose your personal information as described in our Privacy Policy. We may disclose, and you consent to us disclosing, your information to third parties where:

(a) the third party is a joint venturer, business partner, company in the Mick Barlow Property Group, or person we have engaged to act on our behalf as agent or contractor;

(b) ;

(c) we are engaged to sell or manage property, and the third party is an owner of the property you are renting or a prospective buyer or seller of property you own;

(d) the third party is a service provider of Mick Barlow Property, including the providers of IT services, server and web hosting services, data processing services, storage and back-up services, market research services, data analysis services and marketing services;

(e) we do so as part of retaining professional advice (including legal, financial or property advice);

(f) the disclosure is required to affect any transaction where we act as your agent;

(g) we do so as part of advertising or completing the sale of part or all of our business; and

(h) we are required to permitted to do so by law.

4.2 You consent to any disclosure we may make to a related entity. Where such disclosure occurs, your personal information will be deal with in accordance with this Privacy Policy, the APPs and the Act. We make limited disclosures to the following related entities for the purposes of software administration:

(a) AMB Property Group Pty Ltd (trading as Peter Blackshaw Gungahlin); and

(b) Barcon Constructions Pty Ltd.

4.3 We may use or disclose your personal information to provide you with promotional material related to Mick Barlow Property services that may be of interest to you. You may opt-out of our marketing and promotional material at any time by:

(a) contacting our Privacy Officer and requesting that you no longer receive marketing or promotional material; or

(b) unsubscribing by selection the option at the end of our correspondence with you.

 

5. OVERSEAS DISCLOSURE

5.1 You consent to the disclosure of your personal information to overseas recipients where we have engaged them to assist us in the ordinary course of our business as service providers, contractors, employees or advisors. As at the date of this privacy policy, we do not use or disclose personal information outside of Australia.

5.2 If we do disclose personal information outside of Australia in the future, we will take reasonable steps to ensure that overseas recipients use, handle and disclose your personal information in compliance with this Policy, the APPs and the Act

5.3 You agree that if we disclose your personal information to overseas recipients that we are no longer required to ensure that the recipients of your personal information comply with this Policy, the APPs and the Act. You consent on the basis that you will not be liable to you for (and you release us in respect of) any breaches of Australian privacy legislation or this Policy by overseas recipients following disclosure by Mick Barlow Property.

 

6. SECURITY MEASURES

6.1 Mick Barlow Property takes all reasonable precautions to safeguard your personal information. We implement a number of technical and organisational methods to protect your personal information and prevent unauthorised disclosure, misuse, loss, authorised access or modification. Such measures include:

(a) physical locks and alarms on premises;

(b) passwords;

(c) multi-factor authentication;

(d) antivirus systems;

We will take reasonable steps to destroy or de-identify that personal information if we consider that the personal information we hold is no longer required to fulfill the purpose for which it was collected, used or disclosed, a secondary purpose permitted by the APPs or otherwise meet our obligations at law, we will take reasonable steps to destroy or de-identify that personal information.

 

7. ACCESS AND CORRECTION

7.1 You have a right to access any personal information we hold your personal information. Any such request must be made to our Privacy Officer.

7.2 If we deny your request, we will inform you of the basis for the denial, including where we are permitted to deny your request by law because it would not be practicable or reasonable to approve your request.

7.3 We will provide you with access to your information in the format you request it where it is practicable and reasonable for us to do so. While there is no fee associated with making a request, we reserve the right to change a reasonable fee for the retrieval of your personal information where we do provide access.

7.4 If you believe that information, we hold about you is incorrect or incomplete, you may contact our Privacy Officer with a request that your personal information be updated. If we do not consider that your personal information is in need of correction, we are not required to update your information and will give you a written notice setting out our reasons.

7.5 You may request that we delete, destroy, de-identify or remove any of your personal information we hold by sending a request to our privacy officer.

7.6 We will respond to all requests within a reasonable time frame.

 

8. COMPLAINTS

8.1 If you have a complaint in relation to our handling of your personal information, please contact our Privacy Officer with the details of your complaint as well as any supporting evidence you can produce.

8.2 We will review all complaints and respond as soon as practicable.

8.3 If you are unsatisfied with our response, or otherwise do not wish to contact us, you may make a complaint to the Australian Privacy Commissioner at https://www.oaic.gov.au/.

 

9. AUTOMATED DECISION-MAKING SYSTEMS

9.1 We do not use automated decision-making systems which rely on or make decisions regarding the personal information you have provided.

 

10. GOVERNMENT IDENTIFIERS

10.1 Mick Barlow Property does not use, store, or disclose government related identifiers except as required or permitted by law. We may use or disclose a government related identifier where it is reasonably necessary to verify your identity for the purpose of providing our services or as part of due diligence we conduct.

 

11. ANONYMITY

11.1 You also have the option of not identifying yourself in personal information unless by law you are required to do so, or it is impracticable for us to provide you with our services if you do not identify yourself. Where you do not identify yourself, we may not be able to provide you with some or all of our services.
